when tackling a logo, os, or 'default' wall, it's best to try to depart from the original as much as possible - not for legal reasons, but for the artistic merit of the image. many xp walls, for example, consist of little more than a version of the windows flag and some variant text.
a more effective approach might involve finding ways to express 'xp' without using text, and 'quoting' the flag in less direct way.

ex. wallpaper keep up good work only thing i can say against it iz win xp logo a bit on the large side overpowers the main theme.
