As for as the unknown Author, you'll be good to go unless the author sees the BootSkin and has WinCustomize remove it.
Pretty rare of a chance though.
I did have that happen to one of my BootSkins though.
It was up for 5 weeks, got over 6,000 downloads, and then one day it was gone.
The photographer of the photo saw it and got ahold of WinCustomize to remove it.
I had called it, "A Silent Thought". When I had gotten it from the internet, I downloaded it from from a free Geocities website of wallpapers, saying that anyone could use them as they wish.
The wallpapers had numbers and letters for their names.
Well, come to find out, the wallpapers weren't even the person's who had the site up.
Here's an image of what the BootSkin had looked like:
Unfortunately, after they delete the BootSkin, all of your download counts that come from it, also leave when it's deleted.��
But I'm sure you'll be okay.��
P.S.
I'm just taking a guess here, but by the looks of the image with its dither rendering being in pattern format instead of dispersed, I would guess you to have used PhotoShop for this image.
