You shouldn't really release a theme without obtaining permission from the author of work that you didn't create. I'm sure if you contact the owner of the image, he will give his blessing. And if you receive permission, include it in the zip file with the theme. The only time you can upload without permission, is to the "Screenshots" category, because you are not redistributing work by someone else.
The theme looks nice, the colors match perfectly.
