I don't think sampling for NO monetary compensation constitutes stealing. If he/she was getting paid then YES it would be stealing otherwise known as copyright infringement.Though the legal areas are somewhat grey...especially with sampling(look at what that lame idiot Vanilla Ice did with Under pressure from Queen.)
