well, i couldnt keep it the same, or i would be infringing on several copyrights 
also, it needs to be different (if slightly) so its not merely a clone of someone elses work (although some of my friends think that is what it is).

It's worse than a clone, it's a rip, and flipping the play button won't save you in case Microsoft wants to sue you.
