Ok, I'll step in and make a statement. As far as I've read, Stardock would consider this to be "Fan Art". As for (personal gain), I don't believe this person is making any money (profit) from this skin. There are tons of copyrighted stuff here. Bootskins are a good example.
I'm not a spokesman for Stardock, so it might be a good idea for some people to read the rules here. WWW Link

Thanks everyone (accept Buttermaker)for your kind words and support. I'm glad you like it. I had a lot of fun making it. Apostrophe? oops. I thought something looked out of place. I'll include that in my update. Sorry jack of all siutes. This theme took a long time to do and to do a blue one would keep me from makeing other themes that i have in mind and current projects. There still is more HP movies to come and it might have a blue one. Thanks Z71 for your support. This is'not the first time ButterButt made such a stupid observation of my HP themes. Perhaps he should work for Wincustomize as a copyright consultent. I'm sure the staff at Stardock could use a good chuckle.
